The driver accused of hit-and-run after fatally striking a young Ukrainian refugee in Montreal could soon be sentenced.
According to the Journal de Montreal, a judge is analyzing the evidence in an attempt to reach an agreement between the parties to settle the case.
Juan Manuel Becerra Garcia, 46, is charged with fatal hit-and-run for the incident that occurred last December.
On Dec. 13, 2022, 7-year-old Mariia Legenkovska was hit while walking to school with her siblings in Montreal’s Sainte-Marie district.
The driver fled the scene and was arrested hours later, after turning himself in.
The crown prosecution believes that the accused should have known he hit a child, and should have stopped.
The main dispute in the case is whether or not the accused, a family man with no criminal history, knew that he had hit the little girl.
The police had seized Becerra Garcia’s phone in the hope of finding elements that would advance the investigation, but they were unable to unlock it.
In court on Monday, it was announced a confidential facilitation process had begun before a judge, to “find a judicial solution”.
