Interim injunction to suspend eviction of homeless people under Ville-Marie Expressway for 10 days

The Quebec Superior Court granted an interim injunction Tuesday to delay – for 10 days – the eviction of people living in an encampment under the Ville-Marie Expressway.

The Mobile Legal Clinic team and homeless advocates were in court last month seeking to suspend the eviction of people living under the autoroute between Atwater Avenue and Guy Street.

The notice of eviction given by the Transport Ministry was initially scheduled to be served April 1.

The Mobile Legal Clinic and Resilience Montreal took up the legal battle to help people remain at the encampment.


BACKGROUND:


An agreement had been reached March 23 with the Quebec government stipulating the province had an obligation to find housing for residents living under the Ville-Marie.

The parties returned to court after a deal was not reached.

In a social media post Tuesday, the Mobile Legal Clinic team celebrated the judge’s provisional interlocutory injunction.

“The Mobile Legal Clinic is very happy to have been able to help members of the street community keep their homes,” the group wrote on Facebook.

The judge’s interim injunction is also asking the Quebec Transport Ministry to stop any preparatory work that would disrupt the encampments for the next 10 days.

It also wants all parties aiming to dismantle the encampment to cease all communication with the homeless community living there.

It urges the Mobile Legal Clinic to keep working with all parties to find a solution to relocate those living in the encampment.
