Homeless encampment on Notre-Dame cannot be dismantled for 10 days: judge

The Notre-Dame Street encampment cannot be taken down until the end of this month, a judge has ruled.

Quebec Superior Court Judge Babak Barin says Quebec’s Ministry of Transport and Sustainable Mobility (MTQ) cannot dismantle the encampment before June 28.

It ordered officials with the ministry “to cease all steps aimed at evicting and cleaning up the place where the shelters and belongings of people living along Notre-Dame Street East are located.”

The MTQ warned it would dismantle the camp – on Notre-Dame between Pie-IX Boulevard and St-Clément Street – by June 10.

“The Ministry of Transportation and Sustainable Mobility advises you that an eviction and a complete cleaning of the space you are occupying will be done,” the MTQ wrote in a notice June 5. “We invite you to gather your personal belongings and leave the site no later than Tuesday, June 10, 2025. If you feel the need to obtain additional resources, we invite you to contact 211.

“Note that after this date, any abandoned items will be disposed of without further notice.”

That notice was met with an urgent legal proceeding filed in court by the Mobile Legal Clinic (CJI).

“In light of the judgment on the application for an interim injunction, the legal process will continue,” the CJI wrote on Facebook Wednesday. “On the substantive issue, the CJI asks the Court to rule whether, when state or community resources are lacking or insufficient to accommodate homeless people in emergency accommodation resources, they have the right to shelter outside on public land in order to protect their lives and human dignity.”
