Former Quebec judge Jacques Delisle is asking the country’s highest court to overturn last week’s Quebec Court of Appeal ruling that ordered a new trial for the 2009 murder of his wife.
At a brief hearing Wednesday morning in front of the Superior Court in Quebec City, the 88-year-old’s lawyer indicated he would file an application with the Supreme Court of Canada to reject the Court of Appeal’s decision and reinstate the stay of proceedings issued in April 2022.
In the meantime, both parties indicated their willingness to participate in a facilitation conference to move the case forward quickly.
Delisle was found guilty in 2012 of first-degree murder in the death of his wife, Marie Nicole Rainville.
He was sentenced to life in prison with no chance of parole for 25 years.
His initial appeal was dismissed in 2013, and the Supreme Court of Canada refused to hear his case.
Delisle spent nine years behind bars before being freed in 2021 when the federal justice minister ordered a new trial.
He remains free and subject to certain conditions.
