Class-action lawsuit launched by student against Quebec’s professional nursing order over its exam

Authorization for a class-action lawsuit has been filed by a Montreal nursing student against Quebec’s professional nursing order – l’Ordre des infirmiers et infirmières du Québec (OIIQ) – over its controversial nursing exam.

Jason Aurélien is claiming nearly $30,000 in damages and losses from the OIIQ.

He claims to have failed the OIIQ exam three times. He took the exam a fourth time in September 2023 and is still waiting for the results.

In the class-action authorization, Aurélien says the multiple failures have caused him to fear he won’t be able to obtain his nursing title, doubt his abilities, feel ashamed and isolated, experience a drop in self-esteem, and suffer periods of depression, lose income and spend money on exam fees, tutoring, and travel for the test.

A report tabled last week from a commissioner tasked with ensuring fairness in entry exams to Quebec’s professions concluded Quebec’s nursing licensing exam was to blame for high failure rates.

It called on the OIIQ to “get to work” to “correct the flaws in its examination.”

Last week, CEGEP teachers called for the OIIQ to be placed under trusteeship, accusing it of having broken trust with students and the public.
